Tenancy renewal fees.

Family started a new contract on a new property in Aug 18.
Fees charged.
Tenancy renewed for another 12 months in Aug 19.

Renewal fee been asked for.

Am I correct in saying as her tenancy had started before the new rules came into force, they can ask for the renewal fee this time. But not next year's when the total ban on tenancy fees commences?

    Although googling tell me that fees are banned on new or renewed tenancy after 1 Jun 19?

    And this page says this....



    Renewing your tenancy
    You can only be charged for renewing your tenancy when your fixed term contract ends if you signed a tenancy agreement before 1 June 2019 which says you have to pay a renewal fee.

    You can't be charged to renew a tenancy unless this was stated in your previous contract.





    So will depend on what contract states????

    I did check k the sticky but missed that one.

    It says



    a) a new Fixed Term tenancy can be negotiated. Since June 1st 2019, a fee can only be charged if the original contract specified this, and only till June 2020.




    So she'll need to read her tenancy agreement.....

    If the tenant has previously agreed the fee (via previous tenancy agrement) it can be charged up to June 2020.

    Or the tenant could opt to move to a periodic (rolling monthly) tenancy - no fee.

    have linked her this thread. And also told her.
    The actual renewal was back in Aug and she's already agreed to 12 months. She did that cos she wanted security as she'd not long had a baby. They did ask for the fees at the same time. She conveniently 'forgot' about them. But they've just asked again. Hence me checking the actual position.

    Edited to add, did tell her at time it would automatically go to periodic, but she wanted the security.

  • Hi can anyone advise. I have rented a property since Feb 2014 via a letting agent and signed an initial agreement that did advise about renewal fees. I am generally asked by email nearing the time of renewal if and how I would like to continue and I have always emailed back asking for the tenancy to be renewed for a further 12 months. I generally get an email back advising the landlord has agreed and a new contract has been posted for me to sign then I am charged and have paid £60 each year for this however I have never received a new contract to sign despite many attempts to request it be sent out. Would an email alone legally bind me to another fixed term contract in which renewal fees are payable or due to the fact I have never actually signed one would this mean my contract is a rolling contract so they should not have actually charged me?
