Can I set up a personal injury trust still?

My solicitor missed the personal injury deadline of 3 years so the case collapsed. The other side had admitted liability etc.

I've had to go through another solicitor who is having to sue the original one for negligence.

Can I still put the compensation I eventually receive in a personal injury trust?
The new solicitors are putting a claim in for exactly the same things the original one had, loss of earnings, injuries suffered etc just not sure if it is still classed as a personal injury claim as the claim is now against a solicitors not my work place
