  • Don’t forget to involve your MP.

This is exactly the kind of issue we pay them for.
And it's not like they've got anything else to do at the moment, having another enforced "holiday".

Never heard of NHS land being privately owned.

Yes, I've complained to PALS at the hospital but unfortunately, the land is owned by Belway and there's nothing they can do about my parking charge.

I doubt this very much, and sounds like PALS fobbing you off.

Wasn't this smaller hospital built on the site of the old QE11 hospital and 200 or so homes have been built by Bellway next to it on the unneeded land sold to them.

It would be very unusual for them to sell the very land the hospital stands on to Bellway Homes who didn't even build the hospital.

The other theory is that Bellway have engaged PCM to manage the whole site until the development is finished, but as usual a scamming PPC is making up the rules to fit the situation.

Hmm... that's interesting. I've written back to PALS and rejected their Chief Executive's excuse pointing out that there were no "no stopping" zone signs which he had alleged and furthermore, the photographic evidence provided clearly shows, my vehicle wasn't causing any congestion or obstruction on the road at that time. I further asked him why it is acceptable to East and North Hertfordshire NHS trust that I am currently being pursued and penalized for making reasonable adjustment on behalf of a disabled passenger under the Equalities Act 2010 to access the services provided by their hospital?

I am currently waiting for their reply.

Finally finished writing to Bellway, the local newspaper as well as my MP.

Have also taken the liberty to write to Guinness book of world records to lay rightful my claim to:

    1. "Parking" my vehicle for the shortest amount of time"(i.e 27 seconds according to PCM)

    2. "The quickest time a parking charge incurred from a parking company MUST BE SUPPORTED BY more than 10 photographic evidence taken by a 3rd party".

Will keep everyone posted of the outcome.

    Thanks.

...forgot to mention, I will also be sending PCM an invoice for the hours I've put in today. Had previously written to them a letter spelling out the terms that I will charge £100 to open & read their letter, £100/hour plus £25 admin to respond to the letter I had read and £250/hour to attend to legal matters relating to their parking charge. They can accept our contractual terms by either sending me a letter to confirm the terms I've stated or alternatiely, they can just accept the contract by sending further letters related to the parking charge.

    Guess which one they did.

And I shall remind the learned Judge about Nicholas Bowen vs ParkingEye where Mr Bowen was awarded £1,550 costs after defending ParkingEye's misconceived claim on a public interest basis by breaching consumer protection law and having an unenforceable contract.

Don't care if my claim is successful or not but if enough victims start charging them and winning in court...
  • hi everyone, I could do with some advice. My daughter 5 suffers from mitochondrial disease which has presented itself in many ways and leaves her unable to walk at all. She uses a walking frame. I have recently seperated from my wife and have regular access. My wife has since we seperated attempted to make my life very hard by withholding my passport, money, jewellery etc I’ve risen above and replaced all of the above. But she refuses to give me my daughters blue badge when I have her. I have begged pleaded and clearly outlined just how important this is for our daughter. Still it never travels with her leaving me sometimes having to carry her across car parks untill it’s safe to put her in her frame. She’s five and heavy so it’s not ideal. Sometimes I have to use a push chair which she hates. I’ve tried to apply for a badge of my own but the council have said it belongs to my daughter and not my ex and she should do the decent thing and give me it when I have her. But she still refuses and ignores my pleas. Any advice people????

    Hi Paddy,

I am sorry you are going through a bad patch with your wife at the moment and is walking on very, very thin ice where you could lose access to your daughter altogether in a divorce. I am no legal expert & is not offering any advice at all but I think you can explain your situation to the Citizen Advice Bureau and explore s4, s13(1), s13(4), s19 and s25(4) of the Equality Act 2010 with them.

I too am separated from my wife but nowadays I get to see my children daily and my friendship with my ex-wife is amicable due to the following choices I made to guarantee my access to my children:

    1. My wife has wronged me and it hurts... I brushed it aside and just forget about it completely.

    2. My wife is giving me hell... I manned up, told her every single incident which I had wronged her for the last umpteen years we were married and then kept quiet (not bothering to defend or justify myself) & let her vent out all her anger, frustration, dissappointment, etc, etc just listened and acknowledged her feelings for hours & hours on end over the course of a few days.

    3. And when she's done, I offered to repeat step 2 again and again... and again, even until till this day if she wants to. I am a man and I can take it. As men, we were born to absorb this sort of thing. Men don't do emotions. Women do. And my ex-wife, after venting out all her tears, anger & frustrations, employing emotional blackmail and trying everything under the sun to hurt me, eventually became happy & kind again because "I listened to her quietly & acknowledged her feelings".

    4. I employed this newly acquired skills on my children as well, not responding or reacting to their mistakes, tantrum or emotions but just let them face the consequences of their own actions, acknowledging their anxiety and reassuring them that I have faith in them & trust them completely.

I am still separated from my wife but now everyone is reacting very calmly like me when facing a crisis. I've become a stoic god!

It's either that for me or carry on quarrelling with my wife and lose access to my children in a divorce.

I am glad it worked out for me so, I wish you all the best Paddy. Sorry I can't be of help.

That is for the building not the land.

They flatten the old hospital & build a new one & charge an extortionate amount, within the contract there maybe something about parking, in the same way there will the about Costa

But, the land is still NHS land
Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D
