PPI payment yet didn't put in a claim

My partner just received two letters from Allay, stating they had settled her PPI claim against Lloyds and also an invoice for payment.

Then a couple of days later she recieved some letters from Lloyds, laying out the PPI compensation payment. On one of the letters from Lloyds it has the Allay reference number.

The only problem is that she has never made a claim for PPI and has never filled in any application forms and has not signed any contract or agreement with Allay.

There is also a few discrepencies between the letters.

Allay have claimed for 1 credit card.

Lloyds are paying compensation for 3 cards.

What i really need to know, is there any other way that Allay could have gotten permission to handle my partners data without a wet signature, do they actually need it or is there another way they could act on her behalf.

She is quite happy to pay them the fee as she sees this as a bonus, I on the otherhand are not as easygoing as her and don't see why they should get anything, if they were not legally contracted to do so.

    It seems beyond credibility for the Bank to have received a signed Letter Of Authority from the Claim Company without your partner's involvement.

    Certainly, she can dispute this but the seeming "discrepancy" is simply that the complaint for one card has led to the Bank refunding also for other cards she has held in that account.

    You are at liberty to complain to the Claim Company that they had no permission to act and to refer the complaint to the Ombudsman if the response you receive is not to your satisfaction. However, you should fully expect the company to have documentary proof of your wife's involvement.

    This was my inital thought and i expected there to be a paper trail, i thoroughly interrogated her to confess what she had signed, she didn't break and is now probably looking for divorce lawyers on the internet.

    I was more interested if there was any other way they could get permission, other than a signature that is, i don't want to go on the bounce to Allay and find out she had ticked some box on a form to give them permission.

    i am going to contact the company and get a copy of the contract or whatever it is they used as authority to act on her behalf.

    I didn't fully explain properly, the 3 cards numbers from Lloyds are different from the card number supplied by Allay, it's possible she had a replacement card at some point, but i would have know as i had Sentinal insurance and used to register all the card numbers with them.

    To be honest we have very little information as she hasn't used any credit cards for over 5 years at least and doesn't have any statements.

    Maybe Allay will be able to shed some light on it.

    It doesn't matter, they will all be linked to the same (Lloyds) account.
    There is therefore no "discrepancy" that you can usefully employ to disavow the Claims Company.

    I asked my wife has she ever asked for any check with any company at all, she said she had part filled in a form on Angies Advice on facebook (for a free PPI check), she said she only added her name address, DOB and name of bank, then she closed the page down, she did not sign or agree to anything on the page, this was around February or March this year.

    I sent a SAR to Allay and the Lloyds bank, the LOA from the bank and Allay, has a signature that is nothing like my wife's signature, not even close. The LOA has basic information on it and the date is computer generated and is also 4 months after she went on Angies advice.

    Included in the SAR from Allay, was another LOA with more information on it, but was not signed, i suspect this is the one that should have come by post and been signed by her.

    I guess the next step, is to find out who signed this LOA and why the bank accepted it and then sent private financial information to Allay.

    Allay are getting a letter to ask them where they got this signature from and the bank will also be getting a letter of complaint, she has had numerous loans/credit cards with this bank, they must have had her signature on file.

    She is not really happy about this at all, the bank has sent a lot of private information to Allay.

    What she did was enough for the Claim Company to initiate proceedings I'm afraid. What do you mean, she "closed the page down"? If she filled in her details then Allay will have obviously received them. The fact that the LOA was sent 4 months after she did this is irrelevant.

    Instead of demanding to know why the Bank acted (correctly) on receipt of the Letter Of Authority (LOA), I'd be writing a complaint to Allay that they sent the LOA with signatures which you dispute are genuine. The Claim Company will have eight weeks to consider your complaint, after which you can refer your complaint to the Ombudsman...

    She never submitted the page that's what i mean, she didn't click on check my PPI or click submit, she just filled in the basic details and then stopped when they wanted her email address and decided against it and closed the page. This is why Allay have never contacted her by email, it's because they don't have it as she never filled it in.

    They probably captured the details as she was filling in the page, i don't see that filling in your name and address and bank and phone constitutes a contract for anything, the most they could have done was send information to her.

    Without question the signature is false.

    As already advised, complain to the Claim Company. If you get no joy then you can refer to the Ombudsman..
