I Allegedly Abused their Parking Bay

Hi all,

I got this in the mail today and am flabbergasted. "Parking Bay Abuse" with a shoddy phone camera, taken from his car? Is this even serious? Or is this guy just having a laugh?

How is the car 'abusing the parking space'???

Regardless, I've written this up and wondered what you guys think - it's absurd that thieving companies such as this aren't fined for attempting daylight robbery. Perhaps the government should institute that every POPLA case that the private company loses, the private company should compensate Tax Payers 1000% of the PCN issued (no discounts, so all these losses should cost the private company £1K or more).

I'm sick of turd letters like these ruining what is already a bankrupting high street. And they wonder why brick and mortar shops are closing down.

Any tips/feedback will be much appreciated

Disputing liability for parking charge XXX issued XXX

Dear XXX,

The above vehicle was issued with a parking ticket for parking at XXX Retail on 08/09/2019. This ticket was issued unfairly and the driver is not liable for the parking charge because:

The car was parked within the bay, according to the parking rules.

The photograph used for the PCN does not show 'Parking Bay Abuse'. In this carpark there are no lines painted between the bays. Moreover, the photograph printed on the PCN clearly shows the car parked between the small 'T' markings painted at the front of the bay. I understand that you are obliged to provide evidence that the car was actually parked in breach of the rules.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

    What line? It doesn't look like a properly marked out bay in any case.

    Perhaps, but only marginally, certainly not a breach of contract worthy of a court claim imo, possibly even a vexatious or abusive action.

    Often there is no alternative, especially if the cars to the left and/or right are parked closely. As a disabled person I require some extra room to get out of my car.

    BTW shoddy parking - looks like my blind grandma parked the car. It's well over the line at the front.

    I thought it was just me and/or the OP's link included other photos I'd missed.
  • Clearly not parked within the bay, people should look again at the photo but maybe with your eyes open..
