Bullied out of job, I believe due to pregnancy discrimination

  • Blatchford, yes I can see exactly what you mean. I think you are right. It probably is not worth pursuing especially since she may have started behaving like this for some other reason. The time I can pinpoint her behaviour changing is directly after I said I needed to reduce my massage duties. . But who’s to say something else would not have happened down the line?

    She has only had this business open for 8 months, it’s her first time employing people and she has taken on 10 people. It’s a small business as you say, and some small businesses can get out of paying claims by changing the name they trade under. I imagine she simply is not very good at managing people.

    I guess I will try to just forget about it. But when she took me on she seemed so nice and I trusted her. I just hope she pays me what I’m owed because I certainly can’t afford to work for nothing.

    The reason I thought I may have a case is I know she has no evidence that I’m bad at my job. The 8 written complaints will have been made up.

    I suppose the reason people are being brutal is because that’s what I’d be up against if I took her to court.

    Absolutely. And you could be the leading light for taking on pregnant ladies in your business sector and doing the right thing by them.

    I know it wasn't you who used the word, but actually nobody was being "brutal". These are real world facts. Anyone who thinks that the advice you have had is brutal has never been to an employment tribunal. On a case of this sort, now that is brutal. And as for a case of "slander/libel", well first you need the deposit for such a claim, which runs into tens of £1,000s even before you are allowed to set foot in court and before you pay your lawyer.

    The problem with cut and paste over real world experience is that it all sounds so easy when you read a website.

    I just wanted to reiterate that ACAS are not employment lawyers either and a lot of people that man it may not have the same experience as some of the posters on here.


    Whilst I don't know it, from the style of Blatchford's posting I could imagine they are a person that used to be very active here with a lot of experience in helping employees understand the weaknesses in their cases against employers to better empower them. Their answers weren't necessarily popular but there is a difference between popular and realistic.

    You are the second person to say that my style is like someone else's. Sorry to disappoint, but not the case. I'm not sure what forensic tools people are using to come to that conclusion, but they are way off. Personally I can't tell the difference between half the posters on here just by reading what they say. But maybe I am lacking in some reading skill.

    Please read what was said again. A tribunal must reach the reasonable conclusion that you may have been discriminated against - that requires evidence. It is not a matter of convincing them, but of supplying evidence that leads them to conclude that discrimination may have taken place. That isn't even then the end of it, because all that does is shift the burden of truth from you to the employer, who must then show that they didn't discriminate, and for reasons already stated there are sound grounds upon which they could show that (even if they did discriminate). A tribunal doesn't have a scientific calculator that shows when 51% is reached. Shocked a bit, to be honest, if a specialist employment lawyer has made it seem that simple.
  • OP whilst you may be morally right to be aggrieved & want retribution, is it worth it?

    Is she's half as bad as you say, word will spread throughout the area and anyone half their salt won't touch her business and customers will go elsewhere because they won't get the calibre of staff.
