  • Also my mate doesn't even know how much the other party car was damaged as he was not at the incident. The insurance was not co-operating at all since July. They have now sent the letter that they want to recover the costs of the claim of him... Should he go to seek legal advise?

    No he should come up with a way to start paying it. And also ask his ex friend who has done a runner to help.

    Given his circumstances he might be able to negotiate a lower full and final settlement offer. No harm in trying a low offer such as 50% and see where it gets him. He'll also need to agree a payment plan if he's unable to pay it in one sum. He needs to be pro-active and do this. He can't bury his head in the sand.

    If he doesn't then expect a CCJ and bailiffs to come knocking. The insurer can also enforce by asking the court to order his employer to deduct from his wages each month.

    At least the police were not involved. Do they not seize and crush cars that are on the road without insurance?

    Either way you or your 'friend' will need to pay. What a coincidence that he has now moved abroad - the insurance company can still get him there if they want to.

    No
    They seize cars
    They only crush those that are not reclaimed by the owner having proved they are insured and are not valuable enough to be auctioned
