Motorbike Written Off by Auxillis

I am insured by Hastings Direct. A van driver reversed into my motorbike whilst I was stationary and caused some cosmetic damage. He admitted liability and gave me a flyer with his details which were also sign written on the side of his van, he also wrote the registration number of the van on the flyer.

Hastings Direct put me onto Auxillis who arranged for my bike to be collected and taken to a repairer in Liverpool (no idea why it wasn’t more local, I live in South Wales) They also provided me with a courtesy bike. After about 6 weeks Auxillis informed me my bike was being written off and asked me to transfer the V5 into their name.

They have now informed me that the van driver was not insured and therefore they will not pay out. My insurance was 3rd party fire & theft. I realise that I will not get any pay out but my problem is I no longer have my bike as Auxillis took it away and got me to complete the V5 to transfer it to them.

When they took the bike away I was still able to drive it and am sure I could’ve got something for scrap value or parts.

Is this legal - is there anyway I can get my bike back?

    You can ask MIB for help, as they handle uninsured driver claims. They will find out what has happened and help you deal with it as appropriate.

    The bike is still your property, so the registration will have to be given back to you.

    It might be the case that the third parties van was Insured, but the driver was not on the policy to drive it. In this situation the third party Insurers would still be responsible for your claim.

    Suggest that you speak to MIB and they will explain way forward.

    Auxillis know they won't get paid as much as they thought out of this.

    Writing it off is the easy way of getting this off their to do list.

    Ask for the inspecting engineers full report on your bike so you can make your own assessment about whether to simply say goodbye to it.
