Cancelling a purchase

Good day,

I would like to ask a few questions.

I recently bought (or at least attempted to) purchase a laptop.
However due to the courier being unable to deliver it I decided to return it.
It was bought on finance and while the order was placed on the 31st of August, I was invoiced only on the 3rd of September.
The finance contract was signed on the 1st of September.
I asked the company to take back the item and to proceed to void my credit agreement this afternoon.
Should I worry about potentially being stuck with a credit agreement even if I expressed the wish to cancel today? Is it a wait and see, since I'd like to order a laptop from another retailer that is more local to me?

I would play safe and contact the finance company immediately to cancel the agreement within 14 days

I presume this was purchased online? if so you'll be able to cancel the order under the consumer contract regulations by sending an email, letter or using the model cancellation form they may supply on their website (they need to provide a cancellation form but most include it with delivery) which should also terminate the finance agreement as an ancillary contract. But I'd err on the side of caution and inform the creditor also.

  • Thank you for your answers.
I'm going to clarify the fact that I never received the item.
Delivery was attempted and they left a card. I rebooked twice and twice they failed to show up.
I've contacted the retailer through their messaging system and asked for cancellation. It's not like I can send back something I physically don't have, as it's still with their courier.
I also sent an email to the lender's customer service.
Should I worry about having to pay back that money or is it up to the retailer to refund me so that I can pay off the debt and/or inform the lender about termination (and therefore saving me the hassle)? The lending agreement claims that if I cancel I have to pay back any money owed within 30 days.
  • Sorry for the double post.
Update: the finance company says I have to ask the retailer to cancel the finance with them.
I already sent an email requesting the cancelling of the order (yes, it was online through their website) and the cancellation of the agreement.
Any further worries from now on.

Tl;Dr: ordered a laptop online on 31st, first delivery attempt on 4th, failed redelivery on 6/9 and 13/9, requested cancellation of the order 13/9. The item is not on my premises nor am I physically in possession of the item (or ever received, for that matter) as it's still with the courier. Finance agreement cancellation to be required by the retailer. Any further liable?

Its a high value item so I wouldn't just rely on email notifications.

I'd actually engage CS at the supplier and get a name and agree what will happen. To be honest I'd probably do the same at the finance company.

The item is currently in limbo so you want the vendor to ensure it comes back from the courier as soon as possible and not get into a debate about it being missing and who is responsible.
