Uc

Hi can anyone give me some advice please ?. Have moved home and have to claim UC but been told by Citizens Advice that I should be receiving SDP which I havnt been getting - My problem is now when I go to inform the dwp of my change of address and claim for the SDP it will trigger UC - I should not have to go onto UC as Ive now found out I am entitled to SDP but they never gave me it. Has anyone been in this situation before ? and advice would be welcome. I am currently on legacy benefits of PiP living/mobility standard, ESA support, live alone & no one claims carers - hence being entitled to the SDP. Thanks

Before you moved house were you claiming housing benefit? If so then you you will have SDP included in that claim which will prevent you from claiming UC and you can just claim housing benefit.

In the meantime you should ring ESA and ask to fill out the IS10 form over the phone for the SDP claim and also ask for it to be backdated to when you became entitled to it. It's a very quick process and should be done within about a week, if not less.

Hi poppy thank you for your reply - there was a mix up over the hb and it was closed by the council hence i am having to claim UC now so no live housing benefit claim this was a long winded problem too - I wasnt receiving any SDP at all and only found out about it taking to the advice people - Will i still be able to claim back the SDP and backpay even if I have to claim UC ? finding this all confusing I am now aware I have to claim UC but should not really be in that position as I should have been getting the SDP. If its found I am entitled to the SDP will they move me back onto legacy benefits ?? sorry I am so confused atm

Do not claim UC at all. You need to ring ESA to make a claim for the SDP as advised in my previous comment. Ring ESA now and start that claim, claiming over the phone is the quickest way to claim and i've heard people being awarded within a few days of claiming.

This will delay the claim for housing benefit but it will only be a short delay. Once the claim for SDP has gone through then you'll be able to claim for housing benefit.

It may take as long as 1 hour to get through to DWP but it's a free phone number so keep on hold and someone will eventually answer.
  • Thank you so poppy going to do that now - Advice were supposed to be getting back to me but didnt so i am stuck in limbo what to do - Will I have to give them my new address on the phone as then that will trigger a claim for UC ? - this is why I am so confused about it all and thank you for your help

You will need to give you new address yes but that won't trigger a claim for UC. Number to ring is 0800 169 0310.

No problem at all. I'm glad you came here to ask your question. If i hadn't answered someone else would have.

I'm glad it's sorted. If you haven't already had confirmation once you receive it you can then go ahead and claim housing benefit.
