Land registry correction after purchase

Hi. We're in the process of moving house and there's an issue with the title deeds of the house we're buying as in the information held by the land registry has been confused with the house next door. We've been trying to get the issue sorted for over a month but, as yet, to no avail. The sellers solicitor has offered to sort the issue after completion at no cost to us but our solicitor has advised against it. Meanwhile we have some very 'keen' buyers who want to complete. My question really is, should we wait for the issue to be sorted prior to exchange or should we take the sellers solicitor up on their offer if it means we can get the chain moving? I've spoken to the land registry on their forum page and they can't really give me any info on expected timescales. Thanks

    Are you buying with a mortgage? If so, will your lender be happy to complete on such a basis? Seems unlikely if your solicitor is advising you against it. I doubt the sellers' solicitor can promise that they'll be able to sort the issue.
  • We are buying with a mortgage. Our solicitor said they would need to get our mortgage providers acceptance and that we would need to sign a disclaimer to state we were proceeding against their advice. I'm just trying to look at all our options as if this issue is going to drag on much longer, we may lose our buyer. Thanks
  • Your solicitor should be your guide , that's what you pay for. You can dismiss the advice but it's very fool hardy.

    ...and no I would not complete until this is sorted

    I work as a conveyancing assistant. Please do not go ahead until this is sorted by the seller's solicitor. Once you exchange contracts there is little incentive for the seller's solicitor to do any more work. Even if they have provided your solicitor with an undertaking to "assist" with any requisitions raised by the Land Registry after completion, there will be no need for urgency in this matter and it could drag on for months......
