Set aside a CCJ

Has anyone done this before..set aside a CCJ?

Basically long story short..a few years back my details were used by another person to obtain credit 😡 I’ve been back and fore Experian and the different creditors and slowly the fraudulent information has been removed from my credit file apart from a CCJ!!

The CCJ is registered to an address that I wasn’t living at and had actually moved from three years prior to the judgement being put in place therefore I was in no receipt of any paperwork and it’s only this last year or so I’ve discovered that this information was on my credit report! I don’t even know what the judgment is for!

Is there a chance I could have this set aside? As anyone had this experience before? I know there’s a £255 fee but would gladly pay it to get this off my credit file!

  • If you can present the court with sufficient evidence then yes.

    Do you have a crime report? Or a report to Action Fraud when the fraud was discovered?
  • I did report the matter to the police but somehow they can’t find the incident log even though I recall the officer that dealt with it and again with action fraud they can’t find no records but I did report it 😔 would the electoral register help to show that I wasn’t living at that address at The time the judgement was issued?
  • No - the address won’t matter as you could technically take out credit at any address.
  • It’s crazy!! Until I checked my report some delightful person had taken loads out in my name at a different address I was furious!!
    I might try the consent route and contact the creditor to see if they are happy for it to be removed and explain my circumstances..it’s expires next year but I still don’t want it on there ��

    I'm sure the complainant will be most pleased to hear from you after all these years. When you provide them your current address, they can take the appropriate enforcement action.

    Or they may say, thanks for calling, no we are not interested in getting our money back, or the fees we paid to the courtt all those years ago when we took action against you ... and won!
    Of course we will galdly agree to tell the court to forget all about it.

    I wonder which approach they will adopt? :cool:
  • Consents are usually done if you have the intention of also paying the debt off.

    You need to go the set-aside route.
