    the NEWBIES thread tells unwary and new to the topic defendants not to engage with the claimant or their reps, whereas experienced people like bargepole relish the chat

    my point is , do not lie in court

    if a ticket was purchased and the machine is suspect or faulty, defend as the driver if you were the driver, dont beat about the busg hiding behind POFA, be a credible defendant not an evasive one

    not buying a ticket on a paid for car park is frowned upon, but genuine mistakes where people paid is frustration of contract and HX faulty machines are common, so make them prove their case if the parking was paid for

    de minimis applies, so remember that , plus frustration of contract as well
  • I won!!!!!! Thank you so much for the short notice advice Redx. Gladstones were not there, it was a representative on behalf of the claimant. The judge said that he could tell that I had been on online forums and he didn’t need all that, he wanted the facts of the case so asked me about the day and my parking. Coupon_mad said my defence/appeal was naive but in actually fact, I think it helped...the judge wasn’t interested in ‘stuff online’, he said they couldn’t prove that I didn’t pay and had no proof that their machine wasn’t at fault! The guy was totally unprepared and when the judge asked him if he had any questions, he said yes, what did the machine look like, my reply was it was over a year ago, I have no idea! He said he would be appealing the judges decision but the judge reiterated that he had no defence.
    Thanks again for the support...I’ve not enjoyed the shortness and grumpy replies from some people (felt like a teenager at school being bullied online) but mostly, you have shown love so thank you once again!

    the pressure of trying to help, trying to keep replies concise and stick to the facts and it being like groundhog day on here as we put out the same dish time and time again is what causes those replies etc, but we always want you and others to win, but feel they sometimes dont put in the hours that we do


    its great that you did what you did , said what you said and were as honest as possible, I did say the judges want to get to the crux of the matter , which it seems they did, hence why you won


    GLADSTONES rarely if ever turn up, the PPC,s wont pay their attendance charges, so sent a low rent suit instead , who you beat, so HX lose yet again

I hate that low life cowboys like this try and take people hard earned cash. I’m glad I stuck to my guns because I know I paid and wanted the judge to know that too!
