Can defendant in Small-Claims court charge for ''time spent preparing for trial''??

  • Does the defendant actually have any legal grounds for her claim though that I should be liable to pay her ''money which she would've earned during that 8-week period, as a self-employed contractor, if the brand had chosen to offer her work during that period''?

    *She has provided no evidence showing that she was sacked by the brand, Is simply stating that because I told people who are mutual-associates of both of us about what she did, that as the brand heard about it from other people they apparently chose to not offer her more work due to that (although no evidence has been provided to prove that).

    I've not had chance to read the previous 100+ posts in the other thread but there's enough in this one to get the gist - this could end up being one seriously expensive w**k for the OP :eek:

    It's utter nonsense but needs to be defended. You seem to be dealing with unhinged people. You really, really need professional advice so I won't comment further until you've sought that.

    Thankyou very much for confirming that.

    Sadly I quite simply cannot hire a solicitor though as I don't physically have the money in my bank account to pay their fees, and so cannot hire one. :(


    Moreover the cost of hiring a solicitor could likely surpass the sum of the claim even,
    or in other words if the judge rejects my request for the default-judgement to be overturned not only would I endup having to pay however many thousands of pounds the defendant has listed in her claim, but i'd also have a bill for thousands pounds more from the solicitor for all their time spent peparing for the case + at the actual hearing itself (so would double my cost).

    I said I wouldn't comment but do need to say this. You don't need a solicitor to conduct the case. You need advice from them as how to proceed with this bizarre couple. You may only need an hour or two then diy it from there. You really can't afford not to see one as you are currently on the hook for thousands IIRC.

    I will contact a few solicitor firms in the area of the country nearby where the court is (is 4+ hours away from where I live), and request their advice.

    Hopefully I will be able to find a no-win/low fee firm, or even just a low cost firm.
    The hearing is scheduled for 3-hours, and so hopefully I can find a representative for maybe £100p/h.

    That's what I asked the op to do today.
    Even solicitors who are non practicing are on a list.
    Proving the so called non practicing solicitor May be bogus , and or is in breach of their practice rules, would have been crucial, but if the op hasn't even done this, I'm out.

    And in regards to me hiring a solicitor, I quite simply cannot afford to spend hundreds (let alone thousands of pounds) on hiring a solicitor sadly. :(

    But you could afford to spend £7,500 on 'custom-made videos'?
