Hi all. I am submitting today but have a stupid question about the logistics - KeithP had said to email the defence to CCBC, which I plan on doing. I definitely do not need to fill it online on moneyclaim.gov.uk? As when you start the process of a defence on there, the box will not fit my current defence. Do I do it online as well but say in the box that I have emailed my defence directly to CCBC?0

JUST send the defence by e-mail using the address that KeithP told you about in his standard post (Post # 11 on this thread). Do NOT attempt to put anything on MCOL. Is this the defence that you are sending for the first time, nothing to do with set-aside? If you have court papers, they will instruct you where to send the defence, it may not be the CCBC but the local court.0

Hi all - update on the first issue with the CCJ. I have received a letter from Wandsworth County Court (my local) saying its been assigned to a judge and it is ordered that:
'1. Issue application and list for hearing in the application list on first open date after 22 October 2019, time estimate 20 minutes.
2. No enforcement until the hearing
3. The defendant must file and serve a draft defence by 22 October 2019.'
I am a bit unsure as to what to do next. I assume they are going to get in contact with me regarding a hearing. RE filing a defence - is that then different to the witness statement and draft order I submitted with the N244 paperwork? And do I just email it to Wandsworth County Court? They've not given any details and I can't tell from the other threads if people always submit defences before the hearing or not. I've started drafting one based on prev defences - should I be waiting for something from the claimant beforehand?0 -
It says you should file (to the court) and serve (on the claimant) a draft defence by 22/10/19, after which presumably they will allocate a date. I would have thought that you have everything from the claimant as it would be the original PCN and the POC for that - the one for which you have had the set-aside. Remember when you were asking about set-asides, you were (probably) given advice that, whilst you don't need to file it on the court with your six-point draft order and WS, you should have a viable defence available for defending the original case. That is what the court now wants.0

Thank you. I now have a defence but will finalise it in the next couple of days and post here for some advice if that is ok. The CCJ happened because everything went to my old address, so I need to just check if they sent me the original PCNs and POCs with the stuff they sent me after the SAR. This is UK Car Park Management Ltd rather than PCM, so I just need to make sure of the wording on their notices.0

"I am trying to fight 2 things, both from PCM (UK) via Gladstones. One is a CCJ I need set-aside, and the other is a county court claim. I have emailed the SAR and done the AoS for the claim. I thought I would start with the claim."
Are you now saying there are two different ppc's? i.e.:-
Parking Control Management (UK) Limited (Claimant)

Yes I'm sorry I forgot to amend this, my bad. I was initially confused because all details I had were via phone conversations with the courts and the 2 PPCs have similar names. After some back and forth I realised the CCJ is from UK CPM, which I am appealing to have set aside, and the later claim which turned up in September is from PCM UK. I did put the correct ones on the documentation for each so realised before all this. Does this make a difference with regard to the CCJ being from UK CPM?0
