Backdating standing order?

Do banks backdate standing orders if they've received the paperwork after the date has passed? Mine has, and then sent me over my overdraft limit and now want to charge me. Does anyone know if this is lawful or not?

    It's highly likely the person setting up the standing order didn't check the balance, or perhaps other transactions went through as well which combined with the standing order took you over. Also, depends what's on the mandate and what it's for - if you were paying maintenance fees for a house for example it may be that missing the first payment (due to mandate not being received on time) would have an impact on you as well.

    I think it's worth arguing your case over this to get it back.
  • It was to a debt management company. The standing order form I signed was held up in the postal strike, so the order hadn't been set up. I paid for August over the phone using debit card, bank received instructions to start from August, but took it in September, sending me over my overdraft limit because I had now paid them twice. Who's fault is it that I'm being charged? Surely the bank wouldn't have backdated this.
