Rental Notice Period Scotland

Hi all

My girlfriend is moving out of her rented flat and her landlord has got a two month notice period in her contract that she signed about 5 years ago.

We are in Scotland and I was under the impression that the notice was only 28 days due to a change in the law and all notice periods agreed to before the law change were invalid?

Can someone confirm if the landlord can enforce a two month notice period as it would save her a lot of money otherwise.

    Your girlfriend either has an Assured Tenancy or a Short Assured Tenancy if she signed the contract 5 years ago and she is bound by the terms of that contract so if the notice period is 2 months then it's 2 months notice she needs to give.

    There was no new law introduced but there was s new type of Tenancy introduced in December 2017 but as your girlfriend's tenancy pre-dates this she cannot have a Private Rental Tenancy with the 28 day notice period.
