SORN Penalty on Private Road

    I was in the same situation as you, car SORN on private road. You do need to check with your local council that the road is private this can be done free of charge at some council if you attend in person, there is a small cost if you ask them to do it for you.

    Any way back to my story I decided to defend my case against the DVLA once I had confirmation that the road was private. I informed them that the road was private and that I intended to contest the case in court.

    Throughout my communication with them they repeatedly informed me I was in the wrong never the less I was still prepared to attend court as in the eyes of the DVLA your either on a private road or a public road. Given that I was on a private road I knew I could not lose my case.

    The day before the court case I receive a phone call from the DVLA legal department to say they would not proceed with the case, as they also did a check on the status of the road. I subsequently submitted a compensation claim which was paid .

    Remember they conduct enforcement action in Hope the general public don’t understand the law and hope you just pay up without challenging there action, it’s to generate income believe it or not.

    If your car was SORN and on the public highway they would have clamped it first and a day later removed it.

    If your car was SORN on a private road and you can evidence that you can’t lose. Without knowing the full details that is.
