RCP parking ticket

my car was parked daily at an RCP run car park.

On 5 Jun19 parking was paid via phone but got an error message, So it was then paid agian via a laptop.
It turned out parking had been paid for twice.

RCP were contacted asking for the money back.


no response was recievd from RCP so on 11 Jun19 the car was parked again but no ticket was purchased.


On 11 June the car recieved a parking ticket on it window


On 12 Jun 19 an e mail from RCP was recieved asking for bank details so a refund can be made for the double payment on the 5th June.
a response was sent saying not to refund as no ticket was purchased on the 11th.


No response so it was assumed all parking was paid for.





Today 8 Sept 19 I recieve a notice to keeper or hirer letter from TNC dated 3 Sept 19 saying I owe £125 for the ticket on the 11 June.


It seems a little unfair as

1. They took the money for the day that parking was not paid for
2. Three months has passed, dont they have time limits on these things?

    I think not paying for the 11/06 believing you were square due to the earlier overpayment wasn't the best approach, but it's done now.

  • TNC are debt collectors , contact the dvla and ask when your info was asked for

    What will getting the request date from the DVLA do?
  • sigh , to hold a person liable (OWNER) the parking co or agent must

    1: ANPR or no ticket on car
    ask for and deliver the correct paperwork to the reg keeper within 14 day

    2: ticket left on car
    ask for no earlier than day 29 and no later than day 56

    failure to comply with above is a failure under POFa 2012 and they can only go after the DRIVER


    however if you admitted to being the driver and you admitted parking in the phone call /email , then the above does not apply

    The date the PCN was received and the date the NTK was received don't add up.
    For keeper liability to apply the NTK must arrive by day 14 if ANPR was used or between day 28 and 56 if there was a NTD.

    The free DVLA request will tell you if the PoFA requirements were or were not met for keeper liability to apply.

    This is explained in the NEWBIES you have been asked to read, and itself asks you to read before you start a new thread.

    as a Newbie the newbie thread is quite daunting,



    sometimes "experts" forget that what is simple to them is not always simple to others. There are 1000s of words in the newbie thread, days if not weeks of reading which once read may still not make sense.


    The date I recieved the PCN was 11 June 19
    The date I recieved the NTK was today 9 sept 19 it is dated 3 sept 19


    I have e mailed the DVLA asking when my data was requested.


    The parking for RCP car parks is paid online so they have details


    The e mails regarding overpayment seem to have been ignored. Maybe the people who answer the e mails are not in contact with the department that issues tickets.
