Mis Sold Car Warranty Plan?
Hi.
About a year ago my girlfriend bought a Kia Sportage from a ‘car supermarket’. The whole thing was a bit of a nightmare which involved numerous trips and hours spent at the supermarket in question, not because of problems but just because they said that’s how long it takes. Considering it took me no more than an hour to apply for and successfully receive finance on my car and complete all documentation this already became seriously hard work.
My girlfriend had to wait and go back another day to collect the car and bring her passport to complete everything. She is Australian by birth and has an Australian Passport. When she arrived she was told that finance probably couldn’t be completed because of this even though she told them this at the beginning because she is all too aware of problems like this. Cue, spending nearly the entire day at the supermarket with her 8 year old daughter to sort it out.
We had already said no to service plans, extended warranties and car care kits. I believe at this point she would have signed anything if they told her too and without checking signed up to a £2000 warranty/service package which she only found out about when she asked the finance company for a redemption certificate which seemed high. We checked the paperwork and found the signed document. At this point I’m guessing she has no grounds for arguing that it was mis sold.
HOWEVER! Having recently bought a Kia before this I asked about the 7 year Kia warranty and in no uncertain terms was told that Kia’s warranty only applies to cars bought directly from Kia dealerships. The way companies work these days it wouldn’t surprise me if this was true and I took it as such. I have now discovered this isn’t true and there is still a valid warranty on my girlfriends car. Is this not grounds for being mis sold a warranty plan seeing as there is already one in place?
Sorry for the ramble but the whole ordeal was the worst I have ever experienced. Any advice would be greatly appreciated.

I think she mis-bought it, although sounds like a pressure sale. The time to cancel the warranty plan was before the 14th day in the cooling off period, not 12 months down the line.0

She was told that the car didn’t have the remainder of its 7 year manufacturers warranty because it wasn’t being bought from a Kia dealership.0

You wont get anywhere trying to play the mis-sold card 12 months after you bought it on what the salesperson said to make them sign up to un-necessary warranty.0
