Cancelled claims company but still invoiced

Posts: 12 Forumite

Hi, I contacted a claims company (Allay) in early May but later decided to not use them and sent an email and letter asking for them to cancel the contract.
Since then I have received emails saying "things" are progressing and to every one of these I have replied that I wish to terminate their services.
Lloyds have just made a refund directly to me and now Allay have sent me an invoice for £3k claiming to have done the work.
Where do I stand on paying this? I am quite happy to go to court and produce these emails as proof of my intention to terminate their services.

If the complaint was already submitted to the Bank and was awaiting a decision, it's unlikely that the legally-binding contract you signed would allow cancellation at such a late stage.
You need to check the cancellation terms on your contract, but it sounds like you tried to cancel far too late.
If you don't pay their fee, the firm will certainly chase you through the courts for it, but your evidence of making a cancellation request will not be accepted if it was sent too late in the day..0 -
Contacted them on 02/05 and requested cancellation on 07/05 and they have just ignored these requests and carried on.0

Have to say I don't remember the T&C's regarding cancellation - if I ever read them.
Will try and find out.0 -

If you no longer have a copy of the contract terms and conditions you should find them on the firm's website or you can request they send you a hardcopy...0 -

This should be of some use;

From the point we submit your complaint, you have a 14 day cooling off period during which you can cancel your contract with us. If at any time during the 14 day cooling off period we obtain an offer of compensation for you, our normal fee will be payable.
By my calculation there are at most 6 days between 02/05 and 07/05. Their fee would only be payable if they'd obtained some redress within those few days.0 -
Thanks for the input, they are claiming that as they had submitted the paperwork the following day then the "process" had started from that moment and could not be cancelled even though an actual offer had not been obtained.0
