Car leasing company not sending on penalty notices

Hi Guys!
Need some urgent help. Today we had a bailiff put a note on our car saying we owe the council £500 which was apparently for a yellow box fine back in November 2018.
We lease our car form Audi and have not been sent on a single letter regarding this. Apparently the original fine was £200 and it has now increased.
I will call Audi in the morning but do we have an angle to push them to at lease pay the £300 additional charge?
Any advice would be massively appreciated!!
Many thanks

Why would a baliff leave a note on the car and not serve an action as per procedure?
Yes ring them in the morning , all seems fabricated to me though.

I'd phone the council independently too (look up the number, don't use the one of the notice), since it seems odd they'd send a bailiff to the car without writing to your house yet (which is presumably where the car was).

Thank you. The car is leased so not registered to our home address. My husband spoke to the bailiff and he mentioned that they have CCTV cars from the council so we think he must have seen me driving. He also said they can’t seize the car within a mile of your residence and it was parked in our car park. The paperwork had my hustband’s name on.

The leasing company are not obliged to pass notices to you, but to advise the council of your identity. They must have done that, so you have no chance of compensation.

Anyway, since the car is not yours, presumably the bailiff's can't sieze it?

It's nothing to do with where the car is located, they can't seize it because the car is not yours.

Who is on the V5 as the registered keeper?

Do you not get VED reminders either?

Shouldn't the lease company just pay a PCN, immediately and without question, and then invoice the leasee?

I've seen threads from leasees complaining that they didn't get a chance to appeal a PCN because the lease company paid it- it will be in the T&Cs if they do this, have a look at your paperwork. If they automatically pay a PCN, then it is their fault it has gone up because they haven;t done what they are contracted to do. (And they can pay the other £300)
I want to go back to The Olden Days, when every single thing that I can think of was better.....

(except air quality and Medical Science ;))
  • Lease company should pass details of leasee. I don't see any mention of this in Audi/VWFS PCH contract.

Some companies charge extra for that privilige, for example Fiat/FCA.
"If we receive any fines, fixed penalties or other taxes or impositions relating to the Vehicle and/or its use (the "Fines") you will have to pay us an administration charge of £18 in accordance with condition 9.12 for dealing with correspondence and/or making arrangements in respect of the Fines."
