Manufacturers Warrenty

Please can anyone help
We bought a Peugeot 3008 from JCT 600 with 12 months manufacturers warrenty still on the car on the 28th May 2019 on the 12th July 2019 we returned the car as a fault had occurred. The fault was the car started been very jerky when accelerator had been slightly pressed. The garage has tried to remedy this fault by replacing numerous parts but nothing seems to work. We have been without the car for nearly 8 weeks .The car only had 16,000 miles on the clock. We have had a curtesy car in the time they have tried to fixit. There seems no end in sight as we keep being told they are waiting for new parts.

What action can we take?

Any advice greatly appreciated.

    You could push for a refund, based on the length of time to effect the repair being unreasonable, but if the parts arrive in the next few days and the car is repaired, demanding a refund would appear unreasonable.

    I would suggest that you write to the dealer, give them two weeks to return the car to you fixed, or you will ask for a refund. If you don't have the car back (or you do and the fault returns), write a letter before action giving them a further two weeks to return your money. Then take them to the Court if you have not received the month after two weeks.

    The Consumer Rights Act 2015 would normally allow a dealer to deduct an amount from the refund for the use that has been made of the car even if that use is only for six or seven weeks. Your letter before action might suggest a token deduction for the limited use you have had of the car.
