Online Appeal requires identification of Driver

I've received a PCN from First LLP who are BPA accredited, and I've followed the advice on the Newbies thread in waiting until day 26 to appeal.

However, their options for appeal are either by post, which the thread advised against (and it's probably too late for now anyway) or on their online form. The issue is that the online form has a compulsory box which says "I was driving the car" with options yes or no. I obviously don't want to reveal who was driving but I'm also wary of not telling the truth (I did the drive car to the parking space, although I wasn't in it at the time of the PCN so does that help?)

Any advice on what I should do?

    If that's all that's available, you state you were not the driver. There's nothing in law that requires you to identify the driver in a private parking case.

    In any case, as the parking incident took place some weeks ago (?), you can't be expected to remember who was driving, and you don't keep any form of 'log' either!

    They are obviously trying to trick you

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

    They are just a private company inviting you to pay a speculative invoice or appeal against paying it on their designed website, it's hardly official, and you don't have to identify the drive by law anyway.

    Very restrictive. That's what happened with PPI

    The BPA are NOT monitoring their members yet again

    Complain to the BPA about the lack of a Keeper option , or Other option

    Recently somebody else on here did the same about Initial parking

  • Is there a piece of legislation I should cite in my complaint to the BPA that they've breached by not including a keeper option?

    No , there is no legislation that covers private parking other than POFA

    The BPA only follows the Cop , as should it's members
