Hi, I can't find exact answer on this so would appreciate help.
I have received a pcn from eurocar parks. My car is registered in Northern Ireland but the pcn was received for parking in England. I am the registered owner but was not driving.
Can I appeal based on me not being the driver, as per advice on NI, even though the 'offence' took place in England?

You could appeal to the PPC as a NI resident stating that PoFA doesn't apply, but I suspect you'll just get the standard rejection letter with a POPLA code (PPCs rarely read the detail of an initial appeal).Can I appeal based on me not being the driver, as per advice on NI, even though the 'offence' took place in England?
You could subsequently appeal to POPLA, but outside E/W, POPLA will only consider an appeal if the driver of the vehicle makes that appeal. Doing so blows your main 'defence', that PoFA doesn't apply.
Just follow standard advice for Scotland and NI - ignore it!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
