SABA - Has the driver of my car got a parking fine

I've searched to forum and can't find any advice specific to this case. Sorry if there is.

The driver of my car parked it at a Station car park run by Saba a week ago. The driver of my car used the app to pay for a ticket and went about their normal day. It turns out the ticket actually didn't go through on the app - the driver of my car believes there must have been a fault with the app. The driver of my car realised they hadn't received a confirmation email half way through the day, by then it was too late to buy a ticket as the car park is free after a certain time.

The driver of my car has moved house recently so the post is still going to the old house. The driver of my car has checked several times with house mates to see if a letter has come to the house for them and it hasn't.

The car park has CCTV and you're only allowed 20 mins for free before you have to pay and the only way to pay is through the app. The driver of my car is therefore pretty convinced they would have been sent a parking fine for this.

Questions:
Does anyone have any advice on what to do?
Do Saba only issue fines in the window of a vehicle or can it also come via post. And if so how long do they have to issue it? The driver of my car would rather pay the fine then it go on and on. Should they contact Saba to see if a fine has been issued against this car?

    Set up postal redirection. Saba notices usually come by post. Read other Saba/Indigo threads to see how you don't need to pay.

    Why do you want to pay a scammer that won't go any further than threats assuming this charge was issued under Bye Laws it will time out after 6 months anyway.

    It is not a fine.

    The driver should do nothing, and should not be identified at any point. The driver is an idiot if they want to pay a bunch of unregulated scammers.

    The registered keeper might get a threatogramme called a notice to owner or possibly called a penalty charge, even though the scammers don't know the identity of said owner who is not liable if railway byelaws apply.

    The keeper should first find out if the car park is or isn't relevant land as defined by the PoFA 2012; in other words, find out if it is covered by railway byelaws.
    This will determine the keeper's next course of action if a NTK/NTO arrives.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

  • Okay so a penalty notice has arrived for the the driver of my car. They'd like to appeal it. Does anyone have a pre typed letter with the correct law for their app failing and that's why they were unable to pay?

    The notice must surely be for the KEEPER as neither SABA nor DVLA know driver's name! Use the pre-written appeal in blue text from the NEWBIE sticky, send it as keeper without addition, deletion or modification.
