17minutes parking after struggling with app

Hi all,

I drove my girlfriends car into Vantage point car park in Brighton. I tried downloading the app when there but it took some time and when trying to put my details and trying to pay it just wouldn't let me complete the payment. As didn't have any cash on me I decided to leave the carpark.

I then received a PCN in the post from One Parking Solutions saying I had parked for 17 minutes and as this was over their 10 minute grace period and that the RK was liable. I followed the instructions and posted an appeal using the template advised in the newbie section.

They have now come back with a rejection and given me a popla code.

I've tried looking at other threads that have the same incident but struggling. Any help is appreciated. Is there a specific part regarding the poor app services I can use or shall i just go with the generic complaints about POFA etc...

    Generic appeal points like POFA , no landowner authority , poor signage etc

    Frustration of contract is what is argued for the first grace period exceeding 10 minutes
  • Signage isn’t going to work when you say you tried to download the app.

    Explain you tried to pay, but after you downloads the app it wouldn’t let you make the payment. So rather than park without payment, you did the right thing and left the site and parked elsewhere..

    Even if the signage didn't make it clear that the parking charge was £100 for a seventeen minute stay?
  • Appealing under signage isn’t going to work if you say you tried to pay. By admitting to trying to pay is an admission you knew there was signage at the site as they signage would tell you that you have to pay.

    Yes I understand that.

    And we all know that all private car parks have signs.

    But if the signs do not make it clear that that if one 'breaks the rules' then they have to pay £100, then of course one can appeal that the signage is inadequate.

    this is incorrect, we do not dispute that there was signage, but how do you know that it was correct? do you know the site ?

  • Thanks to all who have replied this far but I am still confused as there seems to be disagreement on the route I should be taking.

    There is disagreement on every forum I have visited in the last 30 years.

    Onthewall has four posts on here. I have a lot more, and I agree with Redx, Ralphy and Keith, between us we have over sixty thousand.
    You never know how far you can go until you go too far.
