UKPC Romford Penalty Charge

Hi All,

Someone I know received a parking ticket for "Not parked correctly within the markings of the bay or space" in a shopping centre. It is from UKPC (UK Parking Control Ltd) who are a BPA Member.

They parked in a mother and child bay (they were taking a son swimming so this was ok), the car was within the overall space but slightly over the line onto the parent/child checkered part but not onto the next space.
No issues caused to any adjacent cars.
They paid as normal for the parking but had a windscreen ticket.

The 'parking charge' is £100

It states reduced payment of £60 if received in 14 days. The newbies thread states to appeal at 26 days.

The template letter below does not mention parking within the bays? Is that the correct process, is there anything else they should do to appeal this?

Template appeal for BPA or IPC members - copy this wording into the online appeal box::

Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

- If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

- If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

- in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

    just use the blue text template , unchanged , appealing as keeper on day 26

    your title needs altering , its a PARKING charge notice , not a PENALTY notice


    nor is their a £100 penalty , its parking charge (its an invoice)

    Edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people. ;)

    Do this now before you do anything else.

    You have not received a penalty charge.

    Send the appeal template in blue unchanged from the keeper around day 26.

    What happened when the keeper complained to the landowner?

    Don't forget to complain to your MP about this unregulated scam.

    Just so you know, UKPC are known fraudsters and have been banned by the DVLA twice, not at this moment though

    Yes they are BPA members but frankly nowadays, it is accepted that the BPA accepts scammers as long as they pay their members fee.

    Assume your lady was shopping so who was the retailer she was spending money with

    Thanks all for the advice.

    The person who received the ticket was using the leisure centre opposite instead of a retailer. It is one of the main parking places in town - you collect a ticket at the barrier and once leaving put the ticket into a ticket machine, pay and then put the ticket into the barrier.
    Therefore I don't think there is an opportunity to have the place or a retailer void the ticket.

    The keeper hasn't complained to the land owner yet? Should they? Not sure if they will get very far?

    if the money was paid then a contract was formed , the landowner wont have any idea about the issues if nobody complains about them

    so landowner complaint , or managing agent if its a multi-outlet retail park

    the newbies thread posts #1 and #3 tell you how to appeal as keeper and when and why (day 26 if its not cancelled beforehand)
