Parking Eye Fine

Long story short, I had a work meeting at a hotel in Bristol and car park is managed by Parking Eye. I had 2hrs free, when I realised I wouldn't be done within this time i went out and paid for more time in the car park. My parking ticket said I had to leave by 13.39, I left at 13.28 (all on camera).
I then get a parking fine of £100 saying I overstayed, I challenged this through POPLA who rejected my claim. I sent a screenshot of my bank showing the parking payment and a copy of my ticket clearly stating I had until 13.39 and the photo of my car leaving 11 minutes before this?!
What the hell do I do now? They saying I now have to pay £100?!!!

    Well obviously as per the NEWBIES thread you will be defending a claim. You know what to do from other threads about ParkingEye claims, when people lose at POPLA, they then get a proper hearing, and we support them and win 99% of them (no CCJ risk).

    But you need to work out why you have a PCN. It's either:

    - you input the VRN a bit wrong at the machine, or

    - you were not actually allowed under the terms, to pay after the free period, or

    - you paid a little late after the 2 hours had expired, counting from the point at which your car crossed the threshold on arrival (the time will be shown under the photo on the first PCN).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    All the information was passed through to POPLA and i went on the time given on my ticket to leave so if it was over or under it wasn't stated on the ticket. Looking at the reviews of POPLA they don't seem to have many fans.
    Not sure what to do now? Do I write to Parking Eye to say I will contest it in court or contact the hotel?

    Contact the hotel and complain as advised above, otherwise just wait for LBA/LBC/LBCC and/or proper county court papers.

    It is not a fine, it is an invoice for the damage the PPC suffered when you did what you did. You do not owe them a penny unless a judge so decides.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    And as I already advised, this is NOT what it is about.

    I want you to look again at the PCN and compare the arrival time with when the 2 hours ended, and WORK OUT why the PCN was sent. Surely the POPLA evidence you saw from PE gives you this, they ALWAYS set out the timelines at the start, in minutes, saying when your car arrived and when payment was actually made, and when the car was captured leaving. All will be revealed.

    Was the payment made within 2 hrs of arrival, that is the question you need to check. It is vital you understand what it is you are to defend in small claims.

    Write bad stuff on the Hotels TripAdviser, Facebook and Trivago pages.

    Yes- don't underestimate the power of complaining to the hotel. Find the Chief Executive, Manager, Marketing manager of the hotel. E-mail them- not just once- but on a regular basis.

    Mention you will be informing the local paper of this
    Mention you will be writing to the local MP
    Mention you will be putting comments on trip adviser/google reviews etc

    I was in the same situation- and the daily e-mails did eventually work!
