    Are the machines very inconspicuous even in LPS' daylight photos? If so, say that and then make the point about why they were impossible to find in the dark. If there was no form of lighting by or above the machines then state that as well - just add that they were 'unlit' to your description of the problems with them. If LPS' own photos do not show any form of lighting adjacent to the machines, then point that out too.
  • Their photo is a daylight photo and they are dark with dark shadows across them, but I think there is a round light above them (possibly not a very bright one). The thing is, I genuinely didn't see them so I don't know what they look like in the dark, but if they are lit up, they might be easier to see in the dark than in the day time, so I think that might go against me.

    Ah, I understand. I bet the light wasn't working but I can see why you're not mentioning lighting as such.

    The location of machines is such a key point that it needs to make maximum impact. How about:

    'LPS' own DAYLIGHT photo shows that the payment machines are black and in an area which is dark and shady even during the day. At night they COULD NOT BE SEEN.'

    It took me a while to understand your first paragraph & POPLA assessors can be even dimmer than me. I know you're trying to avoid quoting from LPS' evidence but I think you do need to indicate which part of their evidence is being rebutted. If LPS have submitted an example of the signs you're describing, I see no problem with stating: 'AS LPS' image of ..... (sign) shows, signs are divided into 2 sections: 1 section with information for Residents and 1 for Non-residents. All signs are the same. Location of machines is ONLY GIVEN in the Residents section and is in small font. As a non-Resident .... etc.'

    I think it's worth nit-picking because I'm now starting to get an impression of a p*ss poor car park and hopefully the assessor will too.
  • Thanks again. I've made the adjustments you suggest and I think I will submit it today as my time is running out. What exactly do they mean by 7 days? I received it on Thursday so to me that means I can submit as late as Thursday, but perhaps it means today?

    I have also written a letter for the manager of the hotel. My MP has written to LPS and I have asked him to also send a similar letter to the hotel manager, so I think I have pretty much exhausted all channels for the moment.

    If you need to cut it down, it's okay to cut out 'the' and 'a' etc. in some places and to use abbreviations as long as you don't dumb down good points. E.g. could say: 'As non-Resident I looked at non-Residents section ... ' and 'For all these reasons, PCN was not correctly issued ....' and so on.
