EPC - Island Green car park Wrexham

Hi All, I've been on the site for a few hours now but am still confused, so worry if I shouldn't of posted a thread.
I honestly didn’t see the parking signs as have a Blue Badge and have not paid for parking before. I had just come from Wrexham hospital round the corner after having been given some very bad news and I just needed somewhere to have a coffee and gather myself before I continued on the long drive home.
Since then I have been in hospital for a couple of weeks and then stuck in the house recuperating for a further few weeks too unwell to deal with post etc. So I actually opened both the first and second letters together. I was of course shocked as I was unaware of the parking charge at the Island Green Retail Park. So I have missed my appeal window.
First Notice to Keeper was for £90 but if paid within 28 days it reduced to £50. Then I got a Final Notification Letter for £90.
Then on Friday I received a letter from Debt Recovery Plus for £150 threatening Court if not paid by 11/09/19.
I'm just really confused at this point if I should ignore it/them or if I should write to either ECP or DRP.
Any help would be much appreciated as the stress this is causing me is making my health even worse.
Thanks

yes you should have posted this thread , stop worrying , its only money, nothing more
ignore DRPL , read post #4 of the NEWBIES faq sticky thread
try to get the landowner or retail park managing agent to cancel it , especially if the keeper was a genuine customer , with receipts or redacted bank statements as proof of patronage
the NEWBIES thread does tell everyone that a landowner cancellation at source is best, we have no idea why people fail to complain and do this, its a total mystery to us , so get onto it asap
what was the date of the incident ?
what was the date of the ECP final notification letter ?
what is the alleged failure of their rules on parking ? overstay ? how much overstay ?
what is stressing you out about it ? its a dispute over an alleged invoice for money, nothing more, its not a criminal offence and nobody is put in prison
its just an invoice from ECP demanding money0 -
Hi,
As I explained I did not get a ticket at all as didn't know I had too.
I'm afraid as I only get Disabled benefit it's exactly the money that worries me.
I parked on 19/06/19
letter issued 26/06/19
Final Notification 26/07/19
DRP letter 28/08/19
I'll send a letter to Costa tomorrow, thanks0 -
I wouldn't worry too much because ECP don't take any legal action. So unless you can get a landowner cancellation (if it's a large retail park, then I suspect Costa won't have authority to cancel), it's a case of ignore anything that comes through your door, unless there's a complete about turn by ECP and they start issuing court proceedings - but it's very highly unlikely.
So if you want to to try to get a landowner cancellation, you're best trying to find out who the site's managing agents are and write to them. Also get your local MP involved and (because I spotted a BBC article about some proposed boycott of the retail park that I posted on here), that the local councillor was heavily involved, so he might be able to help you.

Please be assured that Debt Recovery Plus can do nothing other than issue 'scary' letters, so you must ignore them. Keep all paperwork you receive safely in a file, just in case reference to it is needed at any stage in the future. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

in which case the EA 2010 applies to you
mentioned the EA2010 in your complaint to the landowner or retailer or managing agent
you only have to pay if a judge says so
in future , come here for advice as soon as you receive the pcn0
