Rent Arrears and DRO

Hi All,

Will including my rent arrears in a DRO lead to me being evicted?

I have a payment plan in place to clear these arrears but obviously do not want to lose my flat if a housing association end up evicting me.

I have emailed the housing association so will see what they say but wondered if anyone had dealt with this issue previously.

Thanks.

    Hi,

    From the CAB website :

The DRO period normally lasts for a year. During the period of your DRO you don't need to make any payments towards the debts listed in the order. The creditors of those debts won't be able to take any action against you.
There are some exceptions to this, which are:
    • payments to your landlord for rent arrears. Having a DRO won't stop them from taking possession action against you, so if you want to stay in the property you may need to continue paying any arrears after the DRO is made

As longs as it's less than £50 per month to the arrears.

The arrears payment is not counted as a legitimate expense but you are allowed to make payment from your surplus, which must be less than £50
