Hi,
On 25th January I travelled from London to Bradford with my family and stop at MOTO Cherwell at 19:12 to 21:43. The location where I park my car was near to the main building and I believe there was no sign board mentioning anything regarding parking duration. On 26th of February I received a letter from CP Plus stating that I have parked my car for the time exceeded the free period and I have to pay £100.00 for parking charges or £60.00 if I pay within 14 days.
I seek help on different forums and decided to ignore these letters (since then I have received 3 letters from CP Plus, 3 from DRP and 2 from Zenith Collections). But today I receive a letter from SCS Law.
Title of this letter is : Debt owed to CP Plus Ltd.
IMPORTANT- DO NOT IGNOR THIS LETTER
This letter includes a reference of Supreme Court decision of "ParkingEye vs Beavis (2015) UKSC 67. and that if I don’t pay within next 14 days, CP Plus Ltd. may take steps for legal proceedings against me".
Further stating that "this letter is not a letter of claim and in the event the legal proceedings are issued the amount sought by our client will increase".
I am getting mix response from my friends really don't have any idea what to do, should keep ignoring these letters or should I pay. Please guide me. Please
Oh one more thing its worth mentioning, that was not my car I hired it from Enterprise rent a car for 24 hours. So CP Plus initially contacted them and Enterprise rent a car forward my details to CP Plus as a user of car that day.
Please. Please. Please I am requesting again, someone please help me. Many thanks in advance.

Ignore it , at 14 days it's a debt collector letter
A real LoC gives 30 days and includes financial forms, come back if one arrives
This should have been appealed back at the beginning but too late now
CPP have 6 years to try a court claim0 -
You are still at debt collector stage, even though this is not a debt, only a judge can decide on that.
You should not have ignored in the first place, I don't know what forums you were on certainly not this one, and your friends are making it up as they go along.
You are now in wait and see mode to see if they do try a claim, but come to this forum for help, and chat to your friends about Brexit or something else they probably don't get!0 -
You could try contacting MOTO and see if they will have it cancelled for you.0

As said above ^^^
Understand about debt letters and that includes timewasting junk sent by SCSLaw

Are you a barrister?

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
Many thanks for everyone.
Just one more thing, I am planning to move my house as well (not because of this parking matter). If they decide to go to court against me, I will definitely miss that final letter from them or letter from court. Should I wait for this matter to be fully resolved as do not know how long it will take to resolved?0 -
Tell CP Plus your new address when you move. Set up postal redirection too. That should be fine.0
-
Do this by sending an e-mail with a rectification notice to the DPO of CP Plus dpo@cp-plus.co.ukTell CP Plus your new address when you move.
Very sound advice, amazing how many people don't do this. Also don't forget to change your address on driving licence and V5C (log book) with DVLA.Set up postal redirection too. That should be fine.0 -
Thank you very much all of you for your time. As soon as I got something new I will come back.
Thanks again.0
