Euro Parking Services EPS PCN

Hi,
Sorry to pester you all.
I received a PCN as the keeper of the vehicle from EPS. I appealed on the basis of keeper liability as the NTK was issued outside of the 14 day time limit. However it has been rejected stating that they were in fact within the time limit.
Date of alleged offence: 13/05/2019
Date NTK issued: 28/05/2019
So from the next day 14/05 (this counting as day 1) day 14 would be 27/05. Or am I mistaken and are they just in time by 1 day?!

But the NTK is deemed delivered two working days after the issue date.
Clearly it would be impossible for a NTK dated 28th May to arrive within the required timescale.0 -

Yep it didn’t arrive until 31/05 so how can they deny my appeal?
I’ve been sent a ‘letter before court action’ but I don’t know if that meets requirements or not. I have read countless forums and threads on here but I struggle with my mental health and can’t concentrate etc. It doesn’t seem to be a legitimate LBC. There are no reply forms with it but it states I can pay in full £160 or acknowledge receipt of the letter and full written response within 14 days? What’s my next step. Day 14 being 04/09. What are my options?
I know I can ignore the debt collector letters but I’m moving house soon and I don’t want to miss any court papers. The NTK is not complaint with POFA but my appeal was rejected. The company own the land. The store do not want to help and the local MP has just completely ignored me. Your options are straightforward - there are only two left (based on what you've said above):
1. Pay the charge (we don't recommend that).
2. Wait to see if they issue court proceedings, defend your case and see if a Judge will cancel the charge. They have six years to bring a legal case against you.

Hi.
Redx is right, it's highly unlikely that the PPC own the land. Google to find out how to identify the landowner via Land Registry. But you could also ask other stores served by the car park who the landowner is. Sometimes a quick phone call will get you that information but you might need to hang around waiting to speak to managers etc. You have to be prepared to persevere.
Incidentally, if you're going to be researching and posting here or even just keeping this thread open in case you do get court papers, make sure the parking company cannot easily identify you. Because is has no legal status. They are simply saying that, in their opinion, the invoice was served in time.
The industry is not regulated. If it did get in front of a judge he/she would decide whether it was in time or not in accordance with the POFA.
Nine times out of ten these tickets are scams.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
