Tablet Repair Battle

To cut a long story short I was eventually successful in a claim on care plan with a large high st electrical chain and after over 3 months received a customer returned/ reconditioned tablet.
After 3 weeks tablet kept closing apps so I contacted chain and said I was rejecting product. Was told needed to go to repair centre and I would get a phone call. No call, tablet repaired and on way back to me. Apparently as it was a software issue they can repair not replace.
I have looked at consumer rights act but not completely understanding part about data and repair v replacement.

Any thoughts would be appreciated :D

    How old is the tablet ? It is likely your rights are governed by your contract on the repair plan rather than your consumer rights on the tablet

    Software thats usually the OS needs a reinstall or user software .
    Factory reset usually fixes that .

    Within 30 days you can reject faulty goods and get a refund.

    Beyond 30 days but under 6 months the retailer has to offer a refund, repair or replacement, their choice, providing you can prove the inherent fault.

    Not sure on your time frames but it looks like you went down the repair option. From that if the repaired goods are (still) faulty youre entitled to a refund. If the repaired goods work, no entitlement to refund.

    O and thats consumer rights act stuff, nothing to do with a care plan. For T's and C's of that youll need to look at the documentation relating to it.

    Just clarify the tablet that is currently being repaired which I wanted replaced was a replacement for an un repairable tablet under a care plan. Hope that makes sense

    Youre not using your consumer rights here, youre using rights that are defined in the terms and conditions of that care plan. Theyre different things.

    Can you post the long story (preferably kept to key points) so we know exactly what youve done.

    Had a tablet under a care plan
    Dropped it, broke
    Claimed on care plan
    Original tablet old and un repairable
    Eventually was replaced with a customer returned/ refurbished tablet, like for like replacement
    This replacement tablet became faulty
    I rejected as had for less than 30 days
    Replacement tablet has been repaired, being told as software issue can be repaired under no legal obligation to replace or refund

    Hopefully that clarifies :)
