Whether it's recorded as (partly) your "Fault" rather than "non-Fault" will likely make very little difference to your premium increase ... the premium will increase anyway as you're now a higher risk.
OP - you may well have been able to avoid it. You could have gone left with them (if clear), you could have braked. The simple rule of thumb is never to sit next to another vehicle on any multi-lane road or roundabout. Especially, never sit in their mirror blind spot.
But that's defensive driving, rather than who's actually "at fault". The reason it'll go 50/50 is that it can't be proved either way. It's he-said-she-said. One person says one thing, the other says another, nobody independent backs either side up. Fortunately, it's just a minor bingle, not much money at stake and no injuries or worse.0 -
I came onto the roundabout at 3 o'clock say,TP came at 9, the two lanes on that roundabout at 9 lead into two lanes of the tunnel, left lane - no choice but to enter tunnel, right lane either enter tunnel or carry on around. I was entering tunnel, TP didn't want to so crossed in from of me to avoid it. The insurance company got it on Google maps etc and agreed with me.
When I started my claim my details were given to a 3rd party company to fix my car and provide s hire car which they did, I thought because of that it had been ruled in my favour only to have them call me yesterday with the 50/50 liability thing. My insurance say they don't say anything yet but it's out to the third party company now and they make the descision as it's them that need paying. I'm just worried about how much my premium will rise.
If you haven't already, please read into your agreement with the hire car service. If the claim goes 50/50 or they are unable to retrieve the hire car costs from the other sides insurers, there could be a chance of them holding you liable to pay this.0 -

Without independent witnesses or dashcam footage, it's almost certainly going to go 50:50 because it's your word against the other party's.0

Yes I will read my T&C's thanks all for your help and taking time to reply, as Adrian said, I suppose no-one was hurt, I'll just have to take whatever happens. I will update the thread when I find out. Sorry - no idea how to do the quote thing!0

Yes, that is what happened with my claim, but I went through my own insurance company, then it was sorted out afterwards.
Drivers can claim on the other drivers insurance and claim directly on their insurance, and their insurance company arranges repair.0
