OP here, sorry not replied earlier, could not log back in and tried to contact admin with no luck so opened new account.
Thanks to all who responded, turns out a third party holds the log boo as it is a mobility vehicle, they failed to update with DVLA, they are going to work on getting MIL CCJ set aside on her behalf so looks like all will be good in the end, she is much happier now.
Just wish that the legal team chasing payment had done a proper electoral role search in the 1st place all this could have been avoided.
