My 75 year old father was involved in an accident in December. The injuries sustained resulted in six months in hospital and significant additional care since from family and carers. The other party has admitted negligence and , for the first time in his life, my father now has a solicitor who is seeking compensation for the personal injury on his behalf.
As a family we have never done anything like this before so would be grateful for your advice. The solicitor has asked us to pull together receipts for all the travel expenses incurred. If is agreed will the family members get this money back or will it just go to my father? As he receives pension credit he has been advised to set up a trust if and when he gets any compensation. Assuming he gets paid the travel expenses that family members are submitting will he be allowed to pay them back the money they incurred (train tickets were expensive). My father has said he’s not sure how a trust would work - just that he has to pay the solicitor £1,000 to set it up. Would he be allowed to spend what he wants from it or does all spend have to be justified/evidenced? As he is now terminally ill he would like to have a holiday, if he is given anything and buy a watch (he’s always wanted a smart one) but I wasn’t sure if he would be allowed to do this. Grateful for any advice that you may have. Thank you.
