5 Letters of Claim
Jumpinhot
I have recently received 5 letters of Claim from BW Legal re a Britannia parking garage near where I work. They all refer to offences between March and June. I have not received anything prior to these letters, as I think they may have sent stuff to my old house. The contraventions may be legit, but I object to paying the "legal fees" on top as I never received anything prior to these letters. I have no evidence to submit in my defence with regard to the original offences. Can I still fight this?

Check that your address is correct on your vehicle's Registration Document (V5c).0

Have you updated your V5C (logbook) with the DVLA, otherwise you might have to add a further £1,000 to your 'bill' if the DVLA decide to issue a fine for not updating? If you haven't already done so, you'd better update your driving licence while you're at it (there has to be two separate notifications, there's no read-across, one to the other).I think they may have sent stuff to my old house.
How long have you been away from your former address?
You need to read the NEWBIES FAQ sticky, post #2 which will take you through the whole court process, from receipt of the Letter of Claim (where you are now) right through to any court hearing.
In the sticky you will learn about using a Subject Access Request (SAR) to gain copies of all the previous notices and letters sent to you by Britannia. I suggest you do that request quickly, so you know what you're dealing with and whether there are any 'holes' in their paperwork which we can advise on how to deal with them. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Once you have done as suggested above it would help us to help you if you can give more details of the "alleged" offences.
What did the driver do, why were there ticketed etc etc0 -
You will of course be requiring BW Legal to amalgamate the cases into one claim, using the words you find when you search for:
two claims? abuse of process consolidatedPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So I sent the SARS request, and they have 12 outstanding letters of claim against me. I have proof from bank statements of full day payments for two of them, but I also used the pay machine sometimes and have no proof of payment for those. There was never a ticket on my car of any kind, and the PCNs went to my old address. Is there any point me trying to defend this?0

Yes, you just need to read the NEWBIE sticky post # 2 and some or all of the 17 pre-written defences contained there, pick the one that most nearly matches your circumstances and adapt it to suit. Search the forum for "Abuse of Process" thread posted by beamerguy and commented on in post # 14 of that thread by Coupon-mad and add that to your defence, that will take care of the additional costs they added. Is there any point me trying to defend this?
When/if you receive formal court claims, submit the AoS and then post your defence on here for critique and help. If you don't understand (not unusual at this early stage), read the NEWBIE sticky post # 2 several times until it sinks in.0
