My daughter recieved a parking charge notice from excel over 3 yrs ago ... she ignored the first few letters then got scared... she rang them to say she had paid for a ticket as they said she hadnt displayed a ticket when we know we did as i was with her then when she rang them they said she ad displayed one but it wasnt a valid one ... she asked for photographic evidence and they sent her a pic of her reg ! She rang back to say that wasnt evidence so they said they would send further photos... she heard nothing more until last week ... almost 3 yrs down the line and it was asking her to pay or they would send bailiffs then a few days later she got a ccj that had been made in her absence... she hadnt had the opportunity to defend herself so is asking court to set it aside ... she asked on the fone for excel to send her copies of all correspondence including foto evidence which they daid they couldnt send as she was no longer the owner ! Then the fone went down ! Please any help we would be very grateful...

Why was that?she hadnt had the opportunity to defend herselfPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Firstly, never ever 'phone a scamjer. you need a paper trail if this goes to court.
Secondly, enlist the support of your MP as nine times out of ten these tickets are scams.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0
