Astle Retail Park - Smart Parking Ltd

Hey all
Could really do with some help. My missus has received a PCN from Smart Parking for what they claim is the alleged breach of terms and conditions within the retail park. It was her first time visiting this place and she tells me she paid the full amount on the ticket machine upon exit. Sadly, she has since thrown away the ticket which came out the machine. So, the PCN has arrived today showing two images, one with a vehicle entering timestamp and another with vehicle exiting.
Seeing as we no longer have the ticket, do we have a leg to stand on to make an appeal?

chances are that an incorrect VRM was used (typo ?)
in future , keep those paid for tickets or risk losing money as this old MSE article shows
https://www.moneysavingexpert.com/team-blog/2017/05/throwing-pay-display-ticket-away-use-cost-100/
appeal as KEEPER (not driver , keep that a secret) and use the blue text template from the NEWBIES FAQ sticky thread
also email a sar to their DPO and get copies of redacted pdt paym, ents made in the period around the parking time when the payment was made, plus copies of all paperwork, pictures and data etc
the PDT records may show you something close, or a VRM you recognise that was used instead of the correct VRM
that thrown away ticket was proof of contract, I doubt that you throw away argos receipts ?0 -
Thanks for the reply.
So, just to confirm, the steps i should take are;
1. Appeal as KEEPER using the blue text template (i'm yet to review this), what would be my reason to appeal?
2. Email Smart Parking to their DPO (sorry not sure what DPO is?) to get copies of redacted pdt payments made in the period around the parking time?
Strangely, my missus throwed away the shop receipts for footwear she brought too so no chance of her keeping the parking payment ticket!0 -
Nothing more than what is already in the template.1. Appeal as KEEPER using the blue text template (i'm yet to review this), what would be my reason to appeal?
Send it unchanged - no additions or alterations needed.
Send it as the keeper.
DPO = Data Protection Officer.2. Email Smart Parking to their DPO (sorry not sure what DPO is?) to get copies of redacted pdt payments made in the period around the parking time?
Send a SAR (before you ask - SAR = Subject Access Request) as described at the beginning of post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES thread[/URL].0 -
You are not doing anything , you don't have a defence or an appeal because it's not your PCN , it's your wife's PCN , nothing to do with youThanks for the reply.

So she appeals as keeper
She can email the SAR
Both of you should read that newbies thread , where acronyms are explained in post #5
Not keeping receipts is a loss making venture
Mine now keeps all receipts and has done for 6 years when I found this forum0 -
If people lose v Smart Parking it's only due to not reading the sticky thread.
