    If her insurer picks up any of the cost then she is insured (insurers aren't charities so they don't pay out unless they are contractually required to do so), in which case the original post was about nothing!



    It the case of the OP's sister her Insurance are contractually required to pay out third party claims.

    Not if she's uninsured, there is no contract. They would not have to pay out and that is why the MIB would step in.

    I can't explain it any simpler than I have so I'll say/respond no more on this specific point.

    If you don't agree then we'll just have to disagree.

    There was an insurance policy covering the vehicle at the time of the collision.

    The MIB will not cover damage if you have a comprehensive policy.

    So you and I disagree.

    It's very simple.
    The car is covered by a policy. The insurer have no option but to pay.
    The car is not being driven within the use covered by that policy. The insurer will pass the bill on.
