Contribtion based ESA after SSP has run out

Claims for cont based ESA (new style) can be made after SSP has run out (28 weeks i believe?). Can you claim for cont based ESA after SSP has been exhausted, but you are still getting employer sick pay? As on cont based benefit, you can have income coming in. so i think this is possible as long as you get evidence that the SSP element of the sick pay has been used up..... any advice on this appreciated.

    Yes you can. Occupational sick pay will make no difference to ns-ESA entitlement. You will need the SSP1 form from your employer confirming that your SSP has ended, also a Fit Note.

    If you have the SSP1 before the SSP ends then you can make the ns-ESA claim in advance.

    If there has been a delay claiming the ns-ESA you can backdate it by up to 3 months to get continuity with the end of the SSP.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.
