Recieved LBCCC from PE and then DRP+ letter. What to do?

Hello. I'm not sure how to proceed. So far I've done nothing as I had been in ignorant bliss and thought parking tickets from private firms could be safely ignored.

having read up on these forums there are different courses of action relating to a LBCCC from parking eye and debt collector letters from DRP. I have has DRP letter after teh LBCCC from PE. I'm hoping this means PE have given up.

Here is a timeline of letters:

4th May - PCN from PE
13th May PCN Reminder from PE
7th June PE letter about POFA
22nd June LBCCC from PE
31st July Collection letter from DRP
15th August Notice of intended court actoin from DRP

Should I continue to ignore or start to prepare a defence? I have not entered into any correspondence with either "company" yet.

    Email a SAR to PE to the DPO at PE and obtain all the documents and pictures and data about you and your vehicle attaching a copy of the V5C as proof of ID under the GDPR law

    Strange that PE employed drpl for this, they usually only use debt collection when they are likely to fail, perhaps they failed POFA ?

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    How do I figure out if they failed pofa? The PCN does have a paragraph on the back about it so no golden ticket I think.

    Deep... Thanks. Its a Morrisons car park and as you point out the writing is tiny on the signage and they are high up.

    Shocking that a company that touts its community values allows these scammers to operate on their property!

    Where did the parking event take place? Some landowners expressly forbid PE from taking court action - Aldi is a classic - then the only remaining course of action for PE is to get debt collectors to attempt to extort the money.

    You can safely ignore debt collectors, no matter what the threaten in their letters!

    I don't think I've seen a PE:Morrison's case go to court.

    Have you complained to Ms about this. They always tell PE to cancel. Take all the threatening letters in with you, plus receipts/band/cc statements to show you are a regular Ms customer (especially if you can show payments made for the day of the parking event) and if you have a Ms 'More' loyalty card, take that too. Speak only with the manager as only he/she is likely to have the authority to cancel (Customer Services will likely just fob you off). Lay it on thick that you are a regular customer (if you are), but we've seen cancellations for non-customer fly-parkers in the past.

    If you fail with the local manager, then you write to Ms CEO and he'll cancel for you.

    Bear in mind that often bank/cc statements show the date of the day following the transaction.

  • dont forget to show the letter from DR+ , in fact email CO and enclose it ,

    if PE do not have authority to start court action , morrisons may not be happy about you being threatened

    not a golden ticket then

    so it will be the Morrissons angle , get complaining loud and strong , get it cancelled by M,s
