    Ordinarily, yes, but we had particularly strong winds this month and they might challenge your decision not to take preventative action. I wouldn't be surprised if there was something in the instructions about taking the canopy off in high winds. The canopy doesn't know what month it is!

    I think you might be a bit stuck as the analogy of the toaster and kettle suggests. The retailer is meeting their obligations with their offer and if they wanted to, it's possible they could decline your claim on the basis of contributory negligence. I'd grab their offer.
