VCS > Court Claim Last day to reply

Hi, I've only just dug out my paperwork and noticed today is the last day to reply to my Claim from VCS dated 8th August.

It was a parking fine that I'd ignored not thinking it'd go to the court stage and now I'm in last minute "oh crap should I just pay saying I've left it too late stage".

Is there anything I can do??

    If it is a LoC/LBC/LBA/LBCC (letter before claim) then just send them an e-mail (or letter by snail mail if they don't allow e-mail) refuting the claim and saying you will defend it. If it is a court claim form from Northampton CCBC, then do the AoS on-line today.

    It is a Court Claim.

    Then do the AOS on the government gateway to extend the deadline

    Email a SAR to the DPO at the PPC involved with a copy of the claim form as proof of ID under the GDPR

    Draft your defence and post it below for critique

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    The paperwork and the MCOL website tells you those details

    AOS has to be completed within 14 days of the date of service, to Double the time to draw up a defence , from 14 to 28 days, giving you 33 days from the issue date for the defence

    So you are on the edge of missing the AOS , hence why you should get it done online asap and stop asking questions , lol

    Doing the AOS changes it to defended and changes the deadline day

    Easily googled via Google search or the mcol website

    With a Claim Issue Date of 8th August, you have until Tuesday 27th August to do the Acknowledgement of Service.       Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL] to find out exactly what to do with it.
  • Firstly, thanks for any help I have received so far, its greatly appreciated.

    I've found it extremely difficult to find time to prepare a defence due to personal reasons so I apologise that my defense has to be in today.

    I did the AoS on the last day and since I've tried reading reading various threads.

    I'd like to share the letters/notices and info for your opinions if i could??

    I don't know if these will affect my defense.



    Firtstly the Red and Black notice "This is not a Parking Charge" under the wiper of the car, dated 22/3/19 20:12. Google Map history says the car arrived at the car park at 19:54. With the date the 1st photo was taken being 20:01 and subsequent photo's at 20:02 with the last being 20:13 with the Red and Black notice under the wiper.
