Hire Car and Supermarket PCN

Hi

I’ve looked through previous threads, including newbie info but not been able to discover the best approach so, can someone provide advise please?

A family member parked for less than half an hour in Sainsbury. Spent £40 plus. Parking was paid for but on reflection, can only assume that the incorrect reg no was input (hire car) into the parking machine. Supermarket card transaction details can be supplied for date of ‘offence’.

Hire company letter received advising of fine imposed, and details passed to Horizon, and Hire Company advising they will take £30 admin fee direct from card.

Horizon fine now received, advising of £42 charge within 14 days but asking now for £70 for failure to pay for full duration of stay. Notice dated 18 days after the ‘offence’.

Both letters were received ? sometime this week, when driver away from home. Horizon letter the last to arrive. We are now at 28 day mark from the ‘offence’.

Can someone help with guidance on how best to proceed please ? Thanks

    Read the NEWBIE sticky post # 1 and scroll down to where you see an appeal written in BLUE text. Just below that there are three written by Edna Basher for hire/contract/company cars. Pick the one that suits your circumstances and use it to appeal to the PPC. Separately and immediately contact Sainsbury's (go to the CEO)and insist, as a paying customer, that they have the charge rescinded. When they say they cannot, just point out that you, your family and friends can no longer afford to shop at Sainsbury's if every shop comes with a £xx surcharge. Other supermarkets are available. Also write to the hire company, after checking the t&c's, stating you haven't received a fine but a speculative invoice, therefore you require the admin fee to be refunded.

    Do what he said above ^^^^^^^^^

    Task 1 is complain to the CEO of Sainsbury's and insist on a cancellation

    Task 2 is to complete the appeal before day 28 to the PPC using one of the templates by Edna basher, if it's not cancelled by the supermarket in time, but do not miss their deadline

    Do the tasks in that order , because you want the CEO cancellation first

    Then recover any admin fees last

    Thanks both for your input and direction. There is so much info on here and a lot of jargon I’m trying to take in.

    We shall find details for CEO and advise of store spend etc.

    I had read previously about Edna’s template but really am unclear which is best to use. It’s hire car not lease. And I’m not sure what appeal reasons (legal jargon) should be quoted.

    Should we refer anywhere in our correspondence, ie to:
    1. Supermarket;
    2. Horizon;
    3. Hire company

    that parking was paid but wrong reg may have been input ? And should we also refer to store spend to each?

    Any further Help appreciated.

    Complain to the CEO as Keeper , they won't care about it being a hire vehicle , it's irrelevant to them

    Give them the PCN reference and VRM , and name of the PPC and supermarket location, plus your name and address as day to day keeper

    Attach invoices and receipts or redacted bank statements as proof of patronage because they don't want to upset you as loyal customer


    Adapt the best Edna basher template for the PPC appeal, adding VRM details and PCN reference , plus name and address too

    2 tasks to complete, as hirer or as lessee , meaning as day to day keeper

    The fact it's a hire vehicle is not relevant to the PPC as such, but you appeal it that way which is different than when it's a private vehicle like mine is, hence why you follow the advice by Edna basher

    It is extremely likely that an incorrect VRM was input, but for now it doesn't help

    Add evidence of store spend to the CEO complaint

    What does the hire car agreement say about administrative charges for forwarding invoices for damages for alleged breaches of contract from private parking companies, it is not a fine or penalty charge.?

    If you think that the hire company has erred raise the matter with your local Trading Standards Department.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
