NCP PCN advice

Dear all,

Apologies if the answer to this scenario is in the forum. I've read the newbies thoroughly but can't find a scenario/advice to fit my one.

The ticket is a windscreen one from NCP. It was received in a hospital car park (staff) on 12/6/18 under the reason of "not displaying a valid scratchcard" despite one being displayed. As advised on the forum the driver submitted an appeal as per the template in the newbies thread and received a POPLA code on 18/7/19. A POPLA appeal was never submitted and that 28 day window has passed.

The keeper has now received a NTK from NCP at day 73.

The question is how to proceed. Should the keeper now appeal as per the newbies template or what line of appeal should be followed now.

    Did the driver really appeal the initial PCN, which would be a bad move, or did the keeper appeal?

    Either way, it looks like the scammers do not know or have lost the driver's identity.

    If that is the case then the keeper should appeal using the template in blue from the NEWBIES, adding a one liner that the NTK is non-PoFA complaint therefore the keeper cannot be held liable and the scammers should cancel now to save money.

    What happened when the keeper complained to their employer and union rep?

    Has the keeper complained to their MP about this outrageous unregulated scam that is casing the NHS to lose qualified staff?

    And yes, if you were there for any medical reason or visiting an ill relative, then a strong complaint to PALS or the hospital senior management should be your first priority- even before ‘appealing’ to the ppc.

    Are you sure it is a formal 'Notice to Keeper', headed as such, or is it a Reminder notice? It doesn't make much sense that a formal NtK has been sent so late after having already dismissed your appeal and provided you with a POPLA code.

    Does it relate to the original charge, or is this a separate/new one?
    A POPLA appeal was never submitted and that 28 day window has passed.
    Unless NCP have made an almost unheard of foul-up with the NtKs, by not submitting a POPLA appeal, bang go your chances of getting this resolved and you can expect hassle at any time from NCP, their debt collectors or their solicitors for up to 6 years. NCP have recently started issuing massive numbers of court claims.

    If you are a staff member of the hospital, get on to the department that manages car parking and see if they can intervene.

    And if they are no help, complain to your MP. as nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
