My case with Euro Car Parks

Hi all.

I have used the response template from the stickied thread (thank you), and been issued a POPLA number whilst having my initial appeal rejected by ECP.

Now the question is, do I have a legitimate case to appeal to POPLA:

I visited a pub late one evening, stayed for well under two hours. I didn’t realise i had to input my reg into the terminal at the bar. No bar staff said anything. Had one drink and left.

On re-visiting the pub another day to investigate, the ECP signs are up in the car park, but i failed to spot them on the night in question.

Any advice as to whether i have reasonable grounds to appeal or whether I should take responsibility would be much appreciated.

    Of course you have a case.

    First thing to do is talk to the landlord of the pub to get it cancelled based on what you say above

    No bar staff said anything.

    Do pub landlords have the ability to get it cancelled at this stage? (i.e. i have received a POPLA code)

    You are not likely to win at PoPLA, but have a very good chance if they take you to court. If the landlord refuses to cancel write bad stuff on the pub's TripAdviser oage and any real ale review pages it appears on.

    Also complain to your MP. as nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    The landlord can request cancellation at any time, especially if he wants to safeguard his business

    Especially if you threaten him with bad reviews.
    You never know how far you can go until you go too far.

    You should appeal to POPLA all the pointers are in the newbies thread don't appeal on mitigation though, it's signage, procedural, technical, etc etc
