Terms & conditions- Maldives Competition


General
1. The Promoter is Sunshades Eyewear Pty Limited ABN 112 839 568 of 110A McEvoy Street Alexandria NSW, Australia 2015.
2. Information on how to enter and win the Prize forms part of the terms of entry. Entry into the Competition is deemed acceptance of these Terms and Conditions.
3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions prevail.


Entry Period
1. The Competition opens at 19:00 hours AEDT on Wednesday 14 August 2019 and ends at 09:00 hours AEDT on Friday 6 September 2019.
2. The time of entry will in each case be the time the online entry is received by the Promoter’s database, not at the time of transmission by the entrant.
3. This Competition will be open throughout the Entry Period. Entries must be received by the Promoter by no later than expiry of the Entry Period. Entries received after expiry of the Entry Period will be disqualified. The Promoter is not responsible for any late, lost or misdirected entries.


Eligible Persons


1. Entry is open worldwide. Persons aged 18 years and over are eligible to enter other than persons in the categories of exclusion referred to below.
2. The following persons are excluded from eligibility to enter the Competition - employees and immediate families of the Promoter and their associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin.


How to Enter

1. Register your details including full name, date of birth, country of residence, e-mail address and Instagram handle, and describe in 25 words or less why you need an island escape.
2. All entrants must agree to subscribe to the Le Specs newsletter and must remain subscribed for the duration of the Competition Period.
3. Incomplete or inaccurate entries will be deemed invalid.
4. All Entries become the property of the Promoter.
5. Each Entrant acknowledges that this Competition is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook, and each Entrant releases each of Instagram and Facebook from any claims relating to the Competition.


Number of Entries permitted


1. Only one entry per person will be permitted.


Judging
1. This Competition is a game of skill, and chance plays no part in determining the Winner. All entries will be judged individually on their merits based on the judging criteria referred to below.
2. Judging will take place at the Promoter’s premises. Entries will be judged by a panel of judges appointed by the Promoter.
3. The Entrant who submits the best Entry (as determined by the judges) (Winner)will win the prize referred to below (Prize). The judges’ decision will be final and the Promoter will not enter into any correspondence regarding the judges’ decision.
4. JUDGING CRITERIA- Entries will be judged on originality, creativity, humour and entertainment value.


Prize

2. Unless otherwise expressly stated, Prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for any change in Prize value from commencement of the Competition and the ultimate Prize redemption date.
3. Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize.
4. The Prize or any component of the Prize cannot be transferred, exchanged or redeemed for cash.
5. It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements. It is the responsibility of the Winner to confirm such conditions with the Prize supplier or other relevant third parties.
6. PRIZE EXPIRY DATE — the Prize must be used by Saturday February 29th 2020. In the event a Winner does not use the Prize by the time stipulated, the entire Prize will be forfeited by the Winner and cash will not be awarded in lieu of the Prize.
7. The Winner acknowledges and accepts that activities that form part of the Prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of God, such as adverse weather conditions or industrial action or civil commotion that may take place. The Winner must make his or her own inquiries about local issues and conditions at destinations prior to travel.
8. The Winner and their guest are responsible for all other expenses including spending money, meals (unless specified), drinks (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the Prize), energy surcharges, services charges, passports, visas, travel insurance and all other ancillary costs.
9. Travel insurance is highly recommended and it is the responsibility of the Winner and their guest to decide whether to take out travel insurance.
10. The Winner is responsible for ensuring that they and their guest are fit to travel and have received appropriate immunisations and/or health checks prior to taking the Prize.
11. Subject to complying with all relevant legislation, the Promoter reserves the right to amend, cancel or suspend this Competition if an event beyond the control of the Promoter corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this Competition.
12. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.


13. If the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize for a Prize of equal or greater value, subject to relevant legislation. It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and Prize supplier’s requirements. The Prize must be taken as stated and no compensation will be payable if a Winner is unable to use the Prize as stated.
14. The Promoter reserves the right to redraw the Prize if an entrant who claims to be a Prize Winner is unable to satisfy these Terms and Conditions.


Winner
1. PRIZE DETERMINATION-17:00 hours AEDT on Friday 6th September 2019 at the offices of the Promoter.
2. NOTIFICATION- The Winner will be notified by email within 3 days and given instructions on how to claim the Prize.
3. Winner will be notified via email and announced on the Le Specs Facebook and Instagram pages by 5:00pm on Monday 9th of September 2019.
4. The Winner must claim the Prize within two business days of being notified by the Promoter (Claim Period).
5. UNCLAIMED PRIZE DRAW —Should the Prize remain unclaimed at the end of the Claim Period, the Promoter reserves the right to award the Prize to the runner-up selected at the time of judging. The Winner of the unclaimed Prize will be notified by email within 2 business days of being selected.


The Flights:
1. The travel plans will be booked from departure and arrival from the Winner’s closest capital city.
2. Travel to and from the Winner’s capital city airport do not form part of the Prize and are the responsibility of the Winner.
3. Dates are subject to flight and seat availability at the time of booking.
4. Flights will be arranged by Flight Centre. The Winner will be given a range of dates to choose from, subject to flight and resort booking availability.
5. It is advised to not travel during peak season, however, is at the discretion of the Winner.
6. Flights and accommodation have no cash value and cannot be refunded, sold or auctioned.
7. Unless expressly stated in these Terms and Conditions, all other expenses will be the responsibility of the Winner and their guest, including spending money, insurance, flight meals, all transfers (unless otherwise stated) including travel to and from the departure point to the airport, travel insurance, some taxes, gratuities, and all other ancillary costs.
8. Flight schedules are subject to change without notice.
9. The Winner and their guest may accumulate reward program points on these flights if they are members of a participating reward program.
10. Passengers unable to travel for any reason who do not notify their airline of choice at least 24 hours prior to departure or do not present themselves at the airport for their flight will forfeit the Prize tickets.
11. Cancellation and/or changes to the flight details once booked will incur the applicable fee(s). The fee(s) applies on a per-guest, per-change basis. All such fees are payable by the Winner and their Guest.
12. The Prize will be sent to the Winner’s nominated email address.
13. Travel insurance is recommended but is not included in the Prize
14. The terms and conditions of each selected airline will apply.


Your information


1. The Promoter is bound by the Privacy Act 1988 (Cth) of Australia. The Promoter will use all personal information collected in connection with the Competition in accordance with its Privacy Policy, which is available at https://au.lespecs.com/pages/privacy-policy.
2. By providing your personal information, you agree to the terms of the Privacy Policy. Without limiting the foregoing, the Promoter may disclose the entrant’s personal information to the Promoter’s related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to the entrant’s relationship with the Promoter.
3. By entering this Competition, you consent to the Promoter using your personal information for the purpose of the Promoter and its related entities sending you information regarding programs, products and services available through them and/or through their business partners, and the Promoter from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly. We will always provide you with the ability to opt out of those communications – see https://au.lespecs.com/pages/privacy-policy.

5. The Winner’s name will be published and retained as required by relevant legislation and as specified in these Terms and Conditions.


General
1. The Promoter reserves the right to request the Winner to provide proof of identity, proof of residency at the nominated address and/or proof of entry validity in order to claim the Prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the Prize in whole and no substitute or compensation will be offered.
2. Entry to this Competition via the Website is free. However, any costs associated with accessing the Website/Instagram are dependent on the internet service provider used by the entrant.
3. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
4. The Promoter reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter and/or the Le Specs brand. This includes, but is not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple entries.
5. Any entrant using any form of software or third party application to enter multiple times (including scripting software) will be disqualified and any claim to the Prize will be invalidated. If such an entrant is awarded the Prize and then found to have breached this clause, the Prize will be immediately forfeited. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
6. An entry must not be unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive or otherwise contain content which, in the Promoter’s sole discretion, is inappropriate or objectionable.
